Minor Visa Applicants May Be Exempt from Certain Health-related Criteria | Migration Amendment (PIC 4005 And 4007) Regulations 2024
For most Australian visas, the visa applicant must meet either Public Interest Criteria (PIC) 4005 or Public Interest Criteria (PIC) 4007, which are health requirements, and undertake specific medical assessments to ensure that they meet the necessary standards under the Migration laws. From 15 October 2024, the Migration Act of 1958's migration health standards will observe major modifications with the introduction of the Migration Amendment (PIC 4005 and PIC 4007) Regulations 2024.
What is the Major Change for PIC 4005 and PIC4007?
Previously, visa applications, including minor applicants were required to be free of diseases or conditions that could result in high healthcare expenditures or limited access to services for Australian citizens and residents.
Under the new regulations, minor visa applicants are exempt from certain health-related criteria that would have otherwise made them ineligible for a visa due to the potential cost of healthcare or community services to the Australian community.
Who will be Affected by the New PIC 4005 and PIC 4007?
This amendment specifically benefits minor visa applicants who are born and living in Australia and have a health condition or disability.
Why were PIC 4005 and PIC4007 Updated?
The revised rules waive this requirement for minor visa applicants who were born and normally reside in Australia. In response to the Royal Commission into Violence, Abuse, Neglect, and Exploitation of People with Disabilities, the Australian Government made this adjustment.
How will the Amended PIC 4005 and PIC4007 Affect My Visa Application?
This amendment applies to visa applications made before or after the commencement of the regulations, including the applications that are under merits review.
