Global Talent Visa (SC 858) to Close For New Applications | Transition to National Innovation Visa (NIV)

As of 6 December 2024, the Global Talent visa (Subclass 858) will be replaced by the National Innovation visa (NIV). This transition involves important changes to the application process, regulations, and potential applicant requirements.

What will happen to My Global Talent (Subclass 858) Visa Application?

  • To Apply Global Talent (Subclass 858) Visa Applications: For Applicants who are preparing and wish to apply for a Global Talent (Subclass 858) Visa, today (5 December 2024) will be the last day that you can lodge the Global Talent Visa (SC 858) application to the Department of Home Affairs. By 6 December 2024, it will transition to the new National Innovation Visa.

  • Pending Global Talent (Subclass 858) Visa Applications: Applicants who submitted a Global Talent visa application before 6 December 2024 will continue to have their applications assessed under the previous legislation in place at the time of their submission.

  • New National Innovation Visa (NIV) Applications: The amendments outlined in the National Innovation regulations will apply only to new applications submitted on or after 6 December 2024.

What Changes Are Being Implemented for the Global Talent Visa (Subclass 858)? 

New Application Form and Submission Methods 

The Migration (Arrangements for Certain Business Skills Visas) Amendment (LIN 24/078) Instrument 2024 introduces the following key changes: 

  • Approved Application Forms: The National Innovation visa can be applied for using: 

    • Form 47NI via ImmiAccount (online). 

    • Form 47NI in paper format submitted via email to an official Department address, but only if authorized by the Department. 
       

Regulatory Amendments 

The Migration Amendment (National Innovation Visa) Regulations 2024 will adjust the Migration Regulations 1994 in several ways: 

  • Renaming: The Global Talent (Class BX) visa will be officially renamed the National Innovation (Class BX) visa throughout the regulations. 

  • Invitation Requirement

    • Applicants must be invited in writing by the Minister to apply for the National Innovation visa. 

    • Applications must be submitted within the timeframe specified in the invitation. 

  • Record of Achievement: The applicant’s record of exceptional and outstanding achievement must match the details provided in the invitation at the time of application. 

  • Repeal of Previous Definitions: The definition of the “Prime Minister’s Special Envoy for Global Business and Talent Attraction” will be removed from the regulations, as it is no longer applicable to National Innovation visa applications. The requirement for endorsement by this envoy, previously necessary for the Global Talent visa, will also be repealed. 

Continuation of Existing Requirements

Most requirements that were applicable to the Global Talent visa will remain in effect for the National Innovation visa, with the amendments primarily involving technical changes regarding the name and specific application processes.
