Administrative Review Tribunal (Miscellaneous Measures) Bill 2024
The Senate Committee on Legal and Constitutional Affairs released its report on the Miscellaneous Measures Bill on 31 October 2024, recommending that the Senate pass it. This followed a public hearing conducted by the Committee on 2 October 2024.
Administrative Review Tribunal (Consequential and Transitional Provisions No. 1) Rules 2024
The Transitional Rules were made on 10 October 2024 and came into effect on 14 October 2024. These rules address several important aspects:
Preservation of Agreements: Ensuring the AAT’s Enterprise Agreement continues to apply to the Tribunal's staff.
Practice Directions and Lists: Establishing arrangements for making practice directions and assigning jurisdictional area leaders immediately after the Tribunal’s commencement.
Application Timeframes: Clarifying timeframes for making applications under the previous and new laws.
Appeals and Applications: Managing appeals and applications to the courts from decisions of the Immigration Assessment Authority (IAA) following its abolition.
Modified Timeframes: The timeframes for making applications for reviews of migration and protection decisions will be adjusted for 6 months post-commencement, allowing individuals in immigration detention 7 working days to lodge their applications.
Consequential Amendments to Regulations and Ordinances
On 10 October 2024, the Governor-General made 6 legislative instruments that amend 99 Commonwealth regulations and ordinances. These amendments replace references to the AAT and the AAT Act, ensuring that the legislative instruments align with the terminology and framework established in the ART Act.
