Partner Visas and Studying in Australia
Australia’s Partner visa program allows eligible non-citizens to live and work in Australia based on their relationship with an Australian citizen, permanent resident (PR) or eligible New Zealand citizen. Partner visa holders who wish to pursue education in Australia generally have the right to do so, but there are a few important factors to consider.
Can You Study While Holding a Partner Visa?
Yes, partner visa applicants and holders can study in Australia. However, the specific conditions depend on which stage of the visa process you are in:
Temporary Partner Visa (Subclass 820 or 309)
While waiting for your Partner Visa (Subclass 820/801), you are granted a bridging visa that allows you to stay in Australia legally. Bridging visas may come with study rights. However, international student fees may still apply.
Once your temporary partner visa (Subclass 820 or 309) is granted, you can study in Australia without any restrictions. However, Subclass 820 or 309 visa holders are not eligible for domestic student benefits like government-funded loans (e.g., HECS-HELP).
Permanent Partner Visa (Subclass 801 or 100)
If you have been granted a permanent partner visa (Subclass 801 or 100), you are considered a permanent resident (PR) of Australia. PR holders can study with no study restrictions. They may qualify for domestic student tuition fees and government education assistance.
Can I Work While Studying?
Temporary and permanent partner visa holders generally have full work rights in Australia. This means you can work while studying, unlike some student visa holders who have work limitations.
