Employer Nomination Scheme (ENS) (Subclass 186) Age Exemption Criteria

The Employer Nomination Scheme (ENS) (Subclass 186) visa is a permanent residency (PR) visa for skilled workers. One visa requirement for the ENS visa applicant is that they must be under the age of 45 at the time of the application. However, there are specific exemptions to this age requirement that can allow older applicants to be eligible. 

 

What is the Employer Nomination Scheme (ENS) (Subclass 186) Visa?

The ENS visa allows skilled workers nominated by an approved Australian employer to live and work in Australia permanently. It is divided into three streams: Temporary Residence Transition (TRT), Direct Entry (DE), and Labour Agreement. Each stream has different eligibility criteria, including work experience, skill assessment, and age limit.

 

Who can be Age Exempted for ENS (Subclass 186) Visa? 

High-Income Earning Exemption 

Applicants who earn above the Fair Work High Income Threshold are eligible for this exemption. High-income professional whose income reflects their significant contributions and skills. 

 

Academic Exemption 

Skilled workers such as professors, lecturers or researchers who have made great contributions to their fields may be age exempted. Skilled workers who are nominated as academics by an Australian university. 

 

Medical Practitioner Exemption 

Medical practitioners who have worked for their nominating employer in regional Australia for at least 4 years out of 6 years immediately preceding the application. 

 

Transitional Arrangement for Temporary Workers

This arrangement is only eligible for workers who were either holding or had applied for a Subclass 457 visa on or before 18 April 2017. It also applies to certain Subclass 482 visa holders.
