How Fast Will Your Sponsored Work Visa Be Processed in Australia?

Section 51 of the Migration Act 1958 allows the Minister or their delegate to consider and dispose of applications for visas in the order that they consider appropriate.

Temporary Skill Shortage (Subclass 482) visas (TSS visa)

  • Nomination applications for the TSS visa are considered in the following order (listed in decreasing priority):

  • Lodge by a party to a labour agreement that was made under the Global Talent Scheme agreement.

  • Nominations lodged for an occupation carried out in regional Australia. Within this category the following are given priority:

    • Parties to a labour agreement made under a Designate Area Migration Agreement.

    • Approved sponsors with Accredited Status. 

    • Any other party to a labour agreement, not previously mentioned.

  • Nominations lodged by approved sponsors with Accredited status, not previously mentioned (i.e. the occupation is not carried out in regional Australia).

  • Nominations lodged by the party to a labour agreement not previously mentioned.

  • All other nomination applications.

The priority for consideration of TSS visa applications are similar:

  • Nominated by the party to labour agreement made under the Global Talent Scheme agreement.

  • The associated nomination is for an occupation to be carried out in regional Australia. Within this category, the following are given priority:

    • Nominated by a party to a labour agreement made under the Designated Area Migration Agreement.

    • Nominated by approved sponsors with Accredited Status.

    • Applicant seeks to satisfy the criteria for grant in the Labour Agreement stream.

  • Nominated by approved sponsors with Accredited Status, if not already mentioned above.

  • Nominated by a party to a labour agreement made under the Designated Area Migration Agreement, if not already mentioned above.

  • Applicant seeks to satisfy the criteria for grant in the Labour Agreement stream.

  • All other visa applications.

Priority for Other Work Visas

The priority for consideration of nomination applications for other skilled migration visas are:

  • Nominations for an Employer Sponsored visa or Regional Sponsored visa by an employer who is a party to a labour agreement under the Designated Area Migration Agreement or Global Talent Program Agreement.

  • Nominations in relation to the Employer Sponsored Regional (provisional) (subclass 494) visa. Within this category the following are given priority:

    • Sponsors with Accredited Status.

    • Parties to a labour agreement not mentioned above.

  • All other nominations lodged in relation to an Employer Sponsored visa. Within this category the following are given priority:

    • nominations by approved sponsors with Accredited Status.

    • nomination lodged by a party to a labour agreement not mentioned above.

  • Nominations lodged in relation to a Regional Sponsored Migration Scheme (subclass 187) visa. Within this priority, nominations lodged by approved sponsors with Accredited Status have precedence.

The priority for consideration of visa applications for other skilled migration visas are:

  • Where the employer is a party to a labour agreement under a Designated Area Migration Agreement or a Global Talent Program Agreement.

  • All applications identified through the Global Talent Program (same priority as above).

  • Visa applications for a Employer-Sponsored Regional (Provisional) (subclass 494) visa. Within this category, the following are given priority:

    • nominated by an approved sponsor with Accredited Status.

    • nominated by a party to a labour agreement not mentioned above.

  • Visa applications for a Skilled Work Regional (Provisional) (subclass 491) visa;

  • Visa applications for an Employer sponsored visa. Within this category the following are given priority:

    • nominated by an approved sponsor with Accredited Status.

    • nominated by a party to a labour agreement not mentioned above.

  • Visa applications for a Regional Sponsored Migration Scheme (subclass 187) visa. Within this category the following are given priority:

    • nominated by an approved sponsor with Accredited Status.

  • Visa applications for a Skilled - Regional (Provisional) (subclass 489) visa.

  • Visa applications for a Skilled – Nominated (subclass 190) visa.

  • Visa applications for a Skilled – Independent (subclass 189) visa in the Points-tested stream;

  • All other visa applications.
