Subclass 407 Visa: Requirements and Application Process

What is the Training Subclass 407 Visa?

The Training (subclass 407) visa allows you to visit Australia to complete workplace-based training (to improve your skills for your current occupation, area of tertiary study, or fields of expertise), or a professional development training program.

What can I do if I have a Training Subclass 407 Visa?

  • Apply for the visa either onshore or offshore. 

  • Live in Australia for up to 2 years and complete the training specified in your application (However, you can’t stay in Australia longer by extending this visa). 

  • Leave and re-enter Australia as many times as you want while the visa is valid. 

  • Bring eligible family members to accompany you to Australia 

Sponsorship and nomination are required, and nomination requirements are different for the three (3) types of occupational training covered by this visa: 

  • Occupational training is required for registration.

  • Occupational training to improve skills in an eligible occupation. 

  • Occupational training for capacity building overseas.  

What are the eligibility requirements for the Training Subclass 407 visa application process?

There are three (3) stages involved in the application process: 

Stage 1 

 The Sponsor must: 

  • apply for the approval of a temporary Activity Sponsor 

  • be either an organisation operating lawfully in Australia, a government agency or a foreign government agency 

  • be able to meet the sponsor’s obligations 

  • have a good business record 

  • obey Australian laws; and  

  • can directly provide training, unless the sponsor is a national Australian Commonwealth Government agency or have an exemption. 

Stage 2 

 The nominator must: 

  • be an approved Temporary Activity Sponsor or have lodged an application to become an approved Temporary Activity Sponsor.

  • satisfy nomination requirements different for the three (3) types of occupational training covered by this visa. 

Occupational training required for registration 

  • Workplace-based training is required to get occupational registration, membership or licensing. The registration, membership or licensing is mandatory to work in that occupation in Australia or your home country

Occupational training to improve skills in an eligible occupation 

  • Workplace-based structured training programs that: 

  • is specifically tailored and timed to the training needs of the nominated person 

  • is in relation to an occupation specified on the list of eligible skilled occupations 

  • involves a nominee who has recent and suitable prior experience. This can include employment experience or study experience that: 

  • is the equivalent of at least 12 months of full-time experience in the occupation 

  • has occurred in the 24 months immediately before the nomination is lodged 

Occupational training for capacity building overseas 

Occupational training for capacity building overseas includes: 

  • Overseas qualification 

  • Structured workplace-based training in Australia for up to 6 months for students who: 

  • Are currently enrolled in a foreign educational institution; and 

  • Must complete a period of practical training, research or observation to get their qualification. 

  • The training must be specifically tailored to the training needs of the nominated person. 

  • Government support 

  • Structured workplace-based occupational training which has: 

  • The support of a government agency in Australia or 

  • the government in the home country of the nominated trainee 

  • Government agency support in Australia must be at the national or state/territory level. 

  • The government in the nominated person’s home country must be at the national, state/territory or provincial level. 

  • The training must be specifically tailored and timed to the training needs of the nominated person 

  • Professional development 

  • Professional development programs of face-to-face teaching in a classroom or similar environment in Australia. It is for overseas employers to send their managerial or professional employees. 

Stage 3 

The Visa applicant must: 

  • have an approved Temporary Activity Sponsor 

  • be nominated 

  • if applying in Australia, currently hold a substantive visa other than a Subclass 403 (Temporary Work (International Relations) visa in the Domestic Worker (Diplomatic or Consular stream), or a Subclass 771 (Transit) visa or a Special Purpose visa 

  • if applying in Australia and not holding a substantive visa, make the application within 28 days after the last substantive visa you held ceased to be in effect 

  • be 18 years old or older (only for Primary Applicant) 

  • have functional English 

  • meet health requirement 

  • meet character requirement 

  • have adequate health insurance 

  • be a genuine temporary entrant 

  • Sign the Australian values statement 

  • have paid back your debt to the Australian government 

  • not have had a visa cancelled or a previous application refused 

  • have the best interest of the child (if an applicant is under 18) 

 

Can I work while I'm in Australia on a Training subclass 407 Visa, and is there any other information I should know about it?

  • Under condition 8102: Primary Applicant must not engage in work in Australia other than in relation to the holder’s course of study or training. 

  • Under condition 8104: Additional applicants must not engage in work for more than 40 hours a fortnight while the holder is in Australia. 

  • The Australian Government is temporarily removing the limit on working hours for all Additional Applicants until further notice. 

How much does it cost to apply for a Training Subclass 407 Visa?

As subclass 407 allows work, there is an abuse of this program. Therefore, in the bid of strengthening the migration program, there is a trend of refusals and problems we found with a poorly prepared application, such as: 

  • The training plan does not adequately demonstrate the genuine capacity to provide tailored and structured training to the visa applicant. 

  • The visa applicant does not demonstrate at least 12 months of experience in the last 24 months. 

  • The visa applicant does not meet the genuine temporary entrant (GTE) test. 

  • The visa applicant is unable to lodge an appeal to the Tribunal. 

What if I’m not eligible for Training Subclass 407 Visa?

Don’t be discouraged if you are not eligible for the Training Visa (Subclass 407), there are other options and pathways that you can take to work in Australia. Check our working visa list or the general skilled migration list, a visa might be suitable for you.
