Student (Subclass 500) Visa Holders Working in Critical Sectors May Temporarily Work Beyond Their Work Restrictions During COVID-19

8104 – Work Restriction for Students

A condition of the Subclass 500 Student visa is condition 8104 – Work Restriction. Condition 8104 does not allow a subclass 500 student visa holder to work over 40 hours per fortnight (20 hours a week). Check subclass 500 visa details and conditions (homeaffairs.gov.au).

 

Temporary Relaxation of Working Hours for Students

  • Subclass 500 Student visa holders may now work over 40 hours a fortnight if they are working in certain critical sectors during the COVID-19 pandemic. These include:

  • Aged care

    • Approved provider or Commonwealth-funded care service provider with RACS ID or NAPS ID, before 8 September 2020

  • Employed by a registered National Disability Insurance Scheme (NDIS)

    • Must be a provider before 23 April 2020

  • Agriculture Sector

  • Tourism and hospitality sector

  • Supermarkets, or associated distribution facility

    • Must be located in an area impacted by COVID-19 lockdown restrictions

    • Only applicable for the duration of the lockdown

  • Accommodation and food services

  • Transport Services: Class 5102 Courier Pick-up and Delivery Services

These sectors have been defined in line with the Australian and New Zealand Standard Industrial Classification (ANZSIC) system.
