Has Your Australian Visa Been Cancelled?
Visa Cancellation
There are many reasons why you may have received a visa cancellation. This may include:
A. breach of visa conditions,
B. character cancellations (e.g. criminal offense or character issues), or
C. providing false and/or misleading information on your previous visa application.
In most circumstances, the Department of Immigration will issue you a Notification of Intention to Consider Cancellation (“NOICC”). You will be given a limited time period to respond and explain why you think your visa should not be cancelled. If this happens, you will need to act fast and get in contact with a visa cancellation specialist as soon as possible.
If your visa had already been cancelled, you may still be able to appeal the Department’s decision at the Administrative Appeals Tribunal (AAT). This also requires you to appeal within a certain time period after your visa is cancelled. Limited time applies so you must act fast to increase your chance of success.
Our team of experienced Immigration Lawyers, two of which are Accredited Specialists in Immigration Law, are highly trained and experienced in assisting clients with visa cancellation issues. We're here to help you.
What Happens If Your Visa Is Cancelled?
Once your visa is cancelled, you immediately become an unlawful non-citizen and can be detained pending removal from Australia. It is imperative that you seek legal advice immediately so that you can regularise your immigration status.
There are five (5) options available to appeal the decision after a visa cancellation:
Reverse case officer's decision by lodging a complaint to the Department.
Get the Tribunal to review the decision again.
Apply to the judicial courts to challenge that the case officer did not follow proper procedures.
Ask the Minister for Immigration to Intervene.
Request the Ombudsman to investigate the Department.
In all cases, you must be aware of the strict time limit available for an appeal.
If you do not act within the strict time limits you will lose your right to review.

Client Testimonial
Partner visa granted despite the previous visa was subject to visa cancellation
We came to Agape when we realized the complication that my partner visa may face due to my prior relationship. The team offered us many solutions. Our application is successfully approved after just one request letter, where the team at AHC provided us with a great legal submission to address all the requirements. Although our journey was not an easy and straightforward one, we got there in the end. Thanks, AHC Lawyers!
