What Can I Do if My Visa Application Has Been Referred to VACCU?

Now that you understand the reason why your visa application is referred to the Visa Applicant Character Consideration Unit (VACCU), you may want to know the next steps and what you can do.

As a refresher, the visa application has presumably been referred to the VACCU because there are possible concerns about the applicant’s meeting the visa application’s character requirements defined in Section 501 of the Migration Act 1958.

What Can I do if My Visa has Been Referred to VACCU?

If your visa application has been referred to VACCU, here are some things a visa applicant can consider doing:

  1. Expect a longer processing time: VACCU assessments can sometimes take several weeks, months, or even years. Be patient during this process. Additionally, it is important to ensure that the applicant holds a valid visa during this process; otherwise, the visa applicant may lose their legal status and be an unlawful non-citizen due to the long processing time.

  2. Respond promptly and provide any additional information requested: VACCU may request further information or documentation from the applicant to assist with their assessment. Alternatively, the visa applicant may receive a Notice of Intention to Consider Refusal (NOICR) or a Notice of Intention to Consider Cancellation (NOICC). Be sure to respond to these requests or notices within the specified timeframe.

  3. Consult professional Immigration Lawyers: Consider scheduling a consultation with an Accredited Specialist in Immigration Law for guidance on the procedures and assistance in preparing submissions or responses to VACCU. Additionally, an Accredited Specialist in Immigration Law can give personalised and tailored advice for the applicant’s next visa pathway to meet their objectives.

  4. Request an extension if needed: If the applicant requires more time to reply to a NOICR or NOICC, they may request an extension. In this situation, the visa matter is typically complex. If the visa applicant requires more time, we suggest that you engage professional assistance to handle your matter and assist you from there.

  5. Emphasise any mitigating factors: If your case includes any compelling reasons or favourable circumstances, emphasise these in your responses to VACCU, which could assist with your matter.

Proactively engaging with the process is essential for effectively navigating any situation. This includes providing all requested information in a timely manner and maintaining thoroughness and transparency in your communications. It is advisable to seek professional assistance from legal representatives who can provide guidance through the complexities of your matter.
