Extended Period to Appeal to ART for Applicants in Immigration Detention
With the introduction of the Administrative Review Tribunal (Consequential and Transitional Provisions No. 1) Amendment Rules 2025 to repeal Section 13 of the Transitional Rules 2024.
What Are the Changes for the ART?
In the past, individuals in immigration detention were required to apply for a review of migration or protection decisions within 7 working days, as outlined in Section 347(3)(a) of the Migration Act 1958. However, with this new change, this timeframe has now been extended to 14 days from the date the individual is notified about the decision.
In effect, Section 13 of the Transitional Rules has been repealed, as it is no longer necessary.
This extension allows affected individuals more time to prepare and submit their appeal application, which helps to create a more consistent process during the transition from Administrative Appeals Tribunal (AAT) to the Administrative Review Tribunal (ART). This change is to promote fairness while also maintaining an efficient workflow, and reviewing migration and visa protection.
