Can My Bridging Visa be Refused?

What Are the Reasons for a Bridging Visa Refusal? 

Your bridging visa may be refused due to multiple reasons similarly to a visa refusal. Common reasons would be: 

  • Failure to meet eligibility requirement. If the applicant does not meet the visa criteria and eligibility to the specific bridging visa, the bridging visa application may be refused. Additionally, if the visa application the applicant applied for is invalid, the bridging visa may be refused. Alternatively, if the applicant applied for the visa outside of Australia, they will not be granted for a bridging visa. 

  • Character grounds. If the applicant fails to meet the character test under section 501 of the Migration Act of 1958, then their bridging visa may lead to a refusal. Even if the applicant has past criminal behaviour or may be a risk to the community, the bridging visa can lead to a refusal. 

  • Breaching visa conditions. If the applicant has previously breached any visa conditions, such as overstaying a visa, or working over their work restrictions condition. This can also lead to a visa refusal. 

 

What Happens if a Bridging Visa is refused? 

If your bridging visa is refused, the applicant may become unlawful and may be at risk of deportation or removal from Australia. You may have the appeal rights to review your bridging visa refusal decision to the Administrative Review Tribunal (ART).
