Australian citizenship by birth can be a straightforward pathway for individuals to obtain citizenship if their parents were Australian citizens when they were born. 

  

Understand Citizenship by Birth & its Eligibilities

According to Australian law, a person born in Australia is automatically considered an Australian citizen under the following circumstances: 

  • A child is an Australian citizen at birth if at least one parent is an Australian citizen or a permanent resident (PR) when the child is born in Australia

  • Alternatively, a child can be recognised as a citizen if they are ordinarily resident in Australia for a continuous period of 10 years starting from their date of birth. This means if the child remains living in Australia for this 10-year period, they may acquire citizenship by evidence, regardless of their parents’ status. We highly suggest that you discuss with an immigration lawyer to see if you meet the 10-year requirement before applying. 

 

How do I Apply for Citizenship by Evidence? 

  • Speak with an immigration lawyer for professional advice and guidance. 

  • At the same time, start gathering documentation, including the Australian birth certificates and parent’s citizenship or residency status, and evidence of continuous residence in Australia for the required period. 

  • There is no requirement to sit the citizenship test for this pathway.
