Age Exemption Guide for SC494 Visa: How to Apply If You're Over 45

The Skilled Employer Sponsored Regional (SESR) (Provisional) visa (subclass 494) is a temporary visa for skilled workers. One of the SESR visa requirements is that the visa applicant must be under 45 years of age at the time of submitting the visa application. However, there are age exemptions to this requirement, which allow older applicants if they meet certain criteria.  

  

What is the Skilled Employer Sponsored Regional (SESR) (Provisional) visa (subclass 494)? 

The SESR visa allows skilled workers nominated to live and work in designated regional Australia for 5 years. It is divided into two streams: the Employer-Sponsored stream and the Labour Agreement stream. Both streams have their own specific eligibility criteria, including work experience, skill assessment, and age limit.  

  

Who can be age-exempted for the SESR (Subclass 494) Visa?   

  1. Skilled workers who work as academics, such as a University Lecturer or Faculty Head at Academic A, B, C, D, or E by an Australian university may be exempt from age.  

  2. Visa applicant is nominated as a scientist, researcher or technical (scientific) specialist at ANZSCO skill level 1 or 2 by an Australian scientific government agency or an Australian university. 

  3. You are nominated as a medical practitioner, and in the last 3 years before you apply for SC494, you must have worked in this role for at least 2 years in a regional area in Australia. You must have held a Temporary Work (Skilled) visa (Subclass 457) or a Temporary Skill Shortage (TSS)/Skill in Demand (SID) (Subclass 482) while working. The role you are nominated for must also be in a regional area. 

  4. If you previously held a Special Category Visa (Subclass 444) or a New Zealand Citizen Family Relationship visa (Subclass 461) for the last 3 years before applying, you may be eligible for the age exemption. You must also have worked for your nominating employer in the same nominated occupation for at least 2 years. 

  5. If you hold a subclass 457 or 482 visa, you must have worked in the nominated occupation for your sponsoring employer for at least 2 years out of the 3 years. In each of those 2 years, your pay must have been equal to or higher than the Fair Work High Income Threshold.
