Subclass 186 Applicants No Need to Commit 2 Years to the Same Employer if transition between employers
As of 7 December 2024, prospective applicants for the Employer Nomination Scheme (ENS) (Subclass 186) visa – Temporary Residence Transition (TRT) stream have an update regarding the employment requirements. The Department of Home Affairs (DoHA) has confirmed that applicants are no longer required to have worked with the same employer for 2 years during the 3 years prior to submitting their ENS (SC186) - TRT stream application.
What are the Key Changes for ENS (Subclass 186) Visa Applicants?
Previous Visa Conditions for ENS (Subclass 186) Visa – TRT Stream
Previously, applicants were required to have worked with the same employer for at least 2 years out of the 3 years (not including any period of unpaid leave) immediately before lodging their visa application.
New Visa Condition for ENS (Subclass 186) Visa – TRT Stream
Applicants who wish to transition between employers are no longer obligated to work with the previous employer to meet the employment requirement of at least 2 years out of the 3 years. They can now work for a new employer while their visa nomination is being processed. Periods of employment between the lodgement of a nomination and its approval will now count towards meeting the visa requirement. However, if applicants wish to proceed with the ENS—TRT Stream, they are still required to be sponsored by the same nominating employer.
