Guide to Applying for the National Innovation Visa (Subclass 858) Expression of Interest (EOI)

The Australian government introduced the National Innovation Visa (NIV) (Subclass 858), which was in effect on 6 December 2024. This visa is for talented and skilled workers with exceptional talent in specific fields who can contribute to Australia’s economy.

What is the National Innovation Visa (Subclass 858)?

SC 858 - NIV is a permanent visa, so when granted, the individual can work and live in Australia indefinitely. The NIV (Subclass 858) targets individuals recognised for their outstanding achievements in various sectors. This includes:

  • Professions

  • Sports

  • Arts

  • Academia and Research

What are the Eligibility Criteria for the National Innovation Visa (SC 858)?

Applicants must meet several key criteria to successfully apply for the National Innovation visa. Below is a list of eligibility criteria:

  • Applicants must have an internationally recognised record of exceptional and outstanding achievement in their field.

  • Applicants must demonstrate that they are still active in their area and contribute positively to the Australian community.

  • Applicants must show that they have the ability to obtain employment or establish themselves independently in their nominated occupation.

  • Some applicants must also be nominated by an Australian individual or an organisation with a national reputation in the relevant field.

What Is the EOI Process for NIV (Subclass 858)?

There are 2 stages when it comes to applying for an NIV (SC 858). Applicants can only apply for the visa after they have been invited by the Department of Home Affairs (DoHA)

  1. Interested individuals must submit an EOI through the DoHA's online ImmiAccount. The EOI is free and is not considered a visa application.

  2. The submitted EOI will remain in the system for 2 years, and the Department will invite candidates based on their set priority order.

  3. The EOI for NIV requests for much less documents and information.

  4. Applicants are only required to have a nominator and complete Form 1000 only if they are under priority group 2.

What Is the Priority Order for NIV (SC 858)?

We have a detailed article on how to determine if you are eligible for the National Innovation Visa (Subclass 858) that DoHA provided following Ministerial Direction 112, which outlines the 5 different priorities of the factors the decision maker should consider when deciding on the NIV (SC 858) application.
