Do I Lose My Bridging Visa if My Application is Refused?

If you receive a visa refusal from the Department of Home Affairs (DoHA), it can be a significant concern, especially regarding the current status of your bridging visa. Understanding what happens after a visa refusal and the associated timeframes is essential for managing your situation effectively.

What Happens After an Application is Refused?

When your substantive visa application is refused, the conditions of your bridging visa may change. Typically, the bridging visa will change its expiry date upon refusal of your visa application, allowing you to take action on your refused visa application. At the same time, you remain in a lawful status in Australia.

After receiving a visa refusal decision, if you hold a valid bridging visa, you typically have 35 days to remain in Australia. You can choose to appeal with the Administrative Review Tribunal (ART) of the visa decision within 28 days of the visa refusal, to apply for a new visa, or make arrangements to leave Australia.

If your visa is refused and the 35-day period has passed, you may be considered an unlawful non-citizen. This can complicate your immigration history for overstaying your visa, we highly suggest that you speak with one of the Accredited Specialists in Immigration Law for tailored advice.

What can I do now?

Now that you have received a visa refusal, read the refusal decision letter carefully. Whether you intend to lodge an appeal or submit a new visa application, doing so within the given limited period is extremely important to maintain your lawful status in Australia. Before taking any action, speak with an immigration lawyer to find a visa pathway that suits your situation.
